Conservation Defense and Enforcement in the Land Trust Community

Acquiring land and easements is just the beginning. Protection requires ongoing monitoring and enforcement, especially now that the legal challenges facing land trusts are increasing. To provide a more systematic understanding of land trust legal challenges, the Land Trust Alliance and the University of Wisconsin Survey Center conducted a national survey of randomly selected local and regional land trusts in 2008.

The highest court in Maine was asked to decide whether land conservation constitutes a charitable purpose. The court answered with a ringing endorsement of the many public benefits of land conservation, including environmental, recreational, economic and health benefits.
