Midwest

Glaciers left an indelible mark on the Midwest, carving out some of the most diverse landscapes on earth. From the Ohio River Valley and the majestic Great Lakes to the mighty Mississippi River, land trusts are protecting the places that make this region special. In rural and urban communities across eight states, 135 local and regional land trust members are safeguarding critical water resources, hardwood forests, prairies, oak savannahs, wetlands, fertile farmland, culturally important sites, trails and the rivers, lakes, streams and groundwater that Midwesterners depend on for fresh drinking water and places to recreate.

Conservation Easement Drafting and Deductibility: Lessons from Recent Tax Court Cases

2020 was a busy year for conservation easement cases in tax and federal appeals courts, and this recent case law affects conservation easement drafting and deductibility.

Want to learn about the on-the ground application of these recent cases and how they may impact your work and the Land Trust Accreditation requirements? Join the Land Trust Alliance, Heart of the Lakes and Gathering Waters on Friday, January 29 at noon Eastern / 11 a.m. Central for a one-hour videoconference. We will focus on:

  • Amendment clauses,
  • Extinguishment and proceeds,
  • Deemed denied clauses, and
  • Reserved rights of building areas and inconsistent uses.

Knowledge about conservation easement drafting will help you follow this session better. Need a refresher? Read the practice element descriptions for Practice 9E on the Learning Center*.
