Conservation Easement Drafting and Baseline Documentation

The land you save with a conservation easement today is the land you will protect and defend tomorrow.  And the next day. And the day after that…  Before accepting this responsibility, land trusts and government agencies accepting easements need to be clear about the commitments they undertake today and the promises they make on behalf of future generations. Does your land trust know if the conservation easements they draft are following best standards and practices?  Have you or your land trust been keeping up with new language to ensure their conservation easements are enforceable in the future?

Whether you or your land trust is new or experienced at drafting conservation easements and baseline reports, this LTA Standards and Practices workshop will provide you with the basics, as well as up-to-date tips on how to improve these documents.  Better documentation will also be helpful if your land trust is interested in accreditation in the future.  In this workshop, participants will learn how to:

• plan conservation easement projects
• draft the easement to fit the plan
• prepare baseline documentation materials to support the monitoring and enforcement of the easement

This is normally a 9 hour workshop, but will be abbreviated to 7.5 hours to accommodate day travel for most Missourians and a brief Missouri Land Trust Coalition business meeting that will precede the workshop.  The baseline documentation chapter (last chapter) will be presented over dinner, which will be provided.

The workshop will be presented by Jane Ellen Hamilton, an experienced attorney and consultant from Colorado.  Jane counsels land trusts and landowners with conservation easement negotiations, and has helped establish conservation easement and stewardship programs for land trusts and public entities.  Jane Ellen is well versed in teaching Land Trust Standards and Practices, and is both an author and reviewer of the Land Trust Alliance’s Curriculum courses.
